Bridge McFarland LLP has secured £225,000 compensation for a 79-year-old client who suffered serious leg injuries after being struck by a forklift truck whilst at work.
Our client was working as an HGV driver and loading his wagon in preparation for deliveries when, without warning, another employee driving a forklift truck reversed into him and knocked him to the ground.
The incident had devastating consequences. Our client suffered fractures to both lower legs, requiring urgent and complex surgery. Metalwork was inserted to stabilise the fractures and he also underwent skin graft procedures. Tragically, the injuries were so severe that his working career was brought to an end, and he may still need further surgery in the future.
Whilst no amount of compensation can undo the physical and emotional impact of such a serious workplace accident, a successful accident at work claim can provide financial security, access to ongoing treatment and rehabilitation, and help individuals move forward following life-changing injuries.
The Importance of Early Rehabilitation
Following the accident, liability was quickly admitted by the employer’s insurers, enabling an early and extensive rehabilitation package to be put in place.
Specialist physiotherapy was arranged soon after the accident and played a vital role in supporting our client’s recovery; helping him regain as much mobility and independence as possible.
Early rehabilitation can often make a significant difference in serious injury claims, helping injured individuals maximise their recovery and adapt to any long-term limitations resulting from their injuries.
A Swift Resolution Following a Life-Changing Accident
A full settlement was agreed with the insurers within just seven months of the accident.
The compensation award of £225,000 included damages for:
- The pain, suffering and loss of amenity caused by the injuries
- Rehabilitation treatment and future medical needs
- Care and assistance provided during recovery
- Loss of earnings and the impact on our client’s ability to continue working
Given our client’s age and the fact that the injuries permanently ended his working life, securing a settlement that recognised both his immediate needs and future losses was particularly important.
For many injured workers, compensation is about much more than a financial award. It can provide access to treatment, relieve financial pressures and help restore security for both the injured person and their family during an incredibly difficult period.
The Ongoing Impact of Workplace Transport Accidents
Incidents involving forklift trucks remain one of the biggest workplace transport risks in the UK. According to the Health and Safety Executive (HSE), lift trucks are involved in approximately a quarter of all workplace transport accidents.
Many of these incidents leave workers facing lengthy recoveries, financial uncertainty and significant changes to their everyday lives. Serious injuries can affect not only the individual involved but also their family, who often provide practical, emotional and financial support during recovery.
This case highlights the importance of maintaining safe systems of work, proper vehicle awareness and effective workplace transport management to help prevent avoidable accidents from occurring.
James Burrell, Partner and Solicitor, who handled the claim, said:
“This was a very nasty accident which our client suffered at work and it has ultimately ended his working career. I am pleased that we have been able to agree a reasonably quick settlement for our client.
“He has been incredibly devoted to his rehabilitation and has done everything that was asked of him. I am amazed at the progress he has made. Hopefully his settlement will allow him to move forwards.”
Our client said:
“After an industrial accident we were in touch with Bridge McFarland, and James visited us a couple of days later. He was so professional, caring and friendly throughout the whole time he assisted us with the claim. James kept us updated at every step of the claim. Any questions we asked were dealt with quickly and nothing was too much trouble for him.
“The claim is now coming to an end and successful. Thank you so much James.”
