The initial case started following a routine hospital review where the shock diagnosis of lung cancer was given. Despite this being incredibly upsetting news they remained upbeat following surgery after being advised that it was non-aggressive and chemotherapy would be undertaken as a precautionary measure only.
A few months later at a follow up appointment they were advised that the surgery had been successful in removing all of the cancer, the chemotherapy would then begin to eliminate the small chance of the cancer returning.
Prior to the start of any chemotherapy treatment his health deteriorated preventing the commencement, a scan from a recent visit was then discussed and they were advised that despite previous advice the cancer had returned. In a further devastating blow they were advised of a terminal prognosis in of a matter of months. Sadly only weeks later he passed away.
It was discovered during the hospital complaints process that there had been historic issues with scans being misinterpreted for some time. Year’s earlier suspicious areas on the lungs were evident on numerous scans.This unnecessary extended delay in undertaking appropriate investigations had such tragic implications for our clients and his loving family. Had a diagnosis been made at the start then the outcome would have been far more positive. The delay resulted in a much poorer diagnosis being made.
The compensation settlement awarded to the family will offer some financial support, but no figure will ever compensate for the true loss suffered by medical negligence.
