Loss of stamps by Royal Philatelic Society of London
Our client was a stamp collector who had sent two potentially valuable stamps to the Royal Philatelic Society of London. The RPSL lost these stamps and we were instructed to claim damages.
RPSL attempted several different defences, the main one being that it was a term of their conditions that the client should have ensured the stamps were insured whilst in their possession. We were able to successfully reject this defence relying upon the Unfair Terms in Consumer Contracts Regulations 1999 (SI 1999/2083) and the considerable amount of guidance as produced by the Office of Fair Trading (“OFT”) in relation to these Regulations. Our client was successful in his claim.
