£50,000 recovered for Grimsby man in Car v Cyclist Road Traffic Accident
Bridge McFarland LLP recover £50,000 for Grimsby man who was run over whilst on his bicycle when a car failed to stop at a give way junction in a Car v Cyclist Road Traffic Accident.
Bridge McFarland LLP has secured £50,000 in damages for a client who had the misfortune of being run over whilst he was on his bicycle approaching a give way junction. The Defendant failed to stop and instead proceeded through the junction colliding with our client.
Due to the impact of the collision our client was knocked from his bicycle sustaining immediate injury to his left leg and after an ambulance was called he was taken to the Diana Princess of Wales Hospital for emergency treatment.
As a result of his accident, he was diagnosed with a subluxed left ankle injury which needed manipulation and plaster. He then subsequently had another attempted reduction before open reduction and internal fixation surgery had to be carried out to his ankle.
Our client had to mobilise on crutches for 4 months and had physiotherapy rehabilitation as part of his recovery.
We secured medical evidence in support of our client’s injuries from an orthopaedic consultant and an orthotic expert. This evidence included recommendations for adapted footwear and future assessments and also indicated the likely problems that our client would continue to have.
Our client had intentions of returning to his employment working on oil rigs, but it became apparent this would not be possible. After gathering a substantial amount of evidence we were able to secure compensation towards this potential loss as we were able to show that had it not been for the accident, he would have been fit to return to such employment.
We also obtained an interim payment for our client whilst in the process of gathering evidence in support of his claim, to ensure that he was not in any financial hardship as a result of the accident.
After negotiations a settlement of £50,000 was secured. Our client was extremely happy with the outcome.
Nicola Williams, Senior Litigation Executive at Bridge McFarland LLP said “this was a completely avoidable accident which resulted in our client having to re-think his future plans and adjust to the realisation that he would have to start his retirement sooner than he had hoped. Our client was there to be seen on his bicycle but the driver failed to give way to him. I am pleased we were able to help our client in his recovery and to secure compensation that would make him feel comfortable in his future retirement. The client was very happy with the outcome and I wish him well for the future”.
