Bridge McFarland LLP has secured damages for the family of a local factory maintenance operative, who sadly lost his life in an accident at work in August 2018.
Mr Green was a longstanding employee at a local mineral factory where he had worked for over 20 years.
Mr Green was carrying out maintenance work on a crane which was located within the roof space of the factory. Suddenly and without warning, his neck became trapped between the crane and a roof truss. Mr Green suffered a cardiac arrest as a result of the entrapment. Unfortunately, Mr Green passed away despite efforts to resuscitate him at the scene.
An Inquest was opened on the 8th March 2019, however due to the pandemic the Inquest was re-scheduled on several occasions. The Inquest finally took place at the Kingston Upon Hull Coroners Court in December 2022. The Jury held that Mr Green died as a result of accidental death which was caused by a neck injury.
An investigation into Mr Green’s death was carried out by the Health and Safety Executive. The Defendant pleaded guilty to an offence contrary to section 2(1) of the Health & Safety at Work Act 1974 in that it failed to discharge the duty to ensure, so far as reasonably practicable, the health and safety of its employees.
How Our Personal Injury Team Helped
Partner Leanne Keating, Personal Injury Specialist, secured compensation for the Claimant, who lost her life partner as a result of the tragic accident. The Claimant described Mr Green as a very loving, kind, loyal, funny, intelligent, hard-working man who was very loved by his partner, son, family and friends.
In March 2024, the Court ordered the Defendant to pay a fine of £366,500 plus prosecution costs of £7,325.82 and a statutory surcharge of £170, an overall total of £373,995.82.
What is the Fatal Accidents Act 1976?
Under the Fatal Accidents Act 1976, bereavement damages can be claimed following the death of a loved one which has occurred as a result of negligence. Although no amount of compensation could ever make up for the loss of a loved one, it can help to financially care for family members who have been left behind.
