Recovery of substantial monies for tractor firm under the retention of title act.
We act for a main importer of leading brands of tractors into the UK. The company had supplied vehicles and parts to one of its customers and was owed substantial sums of money by the customer on unpaid invoices.
Upon discussions between the company and its customer having broken down, the firm was instructed to take legal action to recover possession of the goods pursuant to ‘retention of title’ provisions in the company’s terms of business. On the verge of issuing Court proceedings for an order for delivery up of the goods, the customer company went into Administration. Following careful discussion and negotiation with the Administrator, the bulk of the goods were recovered by the company.
