Skin burn and necrosis
Louise Bush, a Partner in Bridge McFarland’s medical negligence department has helped a client win £5500 in damages for skin burn and necrosis which was caused during an arthroscopic lateral release procedure.
The Claimant had attended their GP for 6 months complaining of worsening pain in their right knee which resulted in a referral to Lincoln County Hospital’s Orthopaedic department. Following a consultation with the hospital it was recommended that they undergo a arthroscopic procedure on their knee.
The surgery took place in September 2008 and the Claimant was discharged from hospital on the same day. The medical records stated that the procedure had taken place but there was no mention of any complications that may have occurred, although the discharge referral form sent to the Practice Nurse noted there was a raw area about 1cm in size which required dressing.
As a result of continued symptoms, and further outpatient appointments, it was then noted the Claimant had suffered from skin burn and necrosis. This required antibiotic treatment and delayed post operative physiotherapy.
The Claimant was unable to return to work for 3 months. In addition, the Claimant has been left with a permanent area of scarring and abnormal skin on their knee.
