A female rugby player who suffered life-changing injuries during an amateur rugby game has won her High Court fight for compensation against the opponent who caused the injury.
The claimant in Czernuszka v King [2023] EWHC 380 (KB) was left with a permanent spinal injury and is now paraplegic after being tackled by the defendant.
Mother-of-two Dani Czernuszka, who was 28 at the time, brought legal action against Natasha King, whom she claimed had dangerously tackled her during a league match between her team Reading Sirens and Bracknell Ladies, in October 2017, and was responsible for her injuries.
Mr Justice Spencer ruled in favour of Czernuszka, finding that King was liable for the unintentional injuries she had caused.
Giving the judgment, Spencer said: “This was a reckless and dangerous act and fell below an acceptable standard of fair play,” he also said. “I do find…that the ‘tackle’ was executed with reckless disregard for the claimant’s safety in a manner which was liable to cause injury and that the defendant was so angry by this time that she closed her eyes to the risk to which she was subjecting the claimant, a risk of injury which was clear and obvious”.

While the court ruled that Czernuszka is entitled to compensation, damages have yet to be awarded and will be assessed later. However, her lawyers have estimated the value of her claim at about £10m.
Ms King has 21 days to seek permission to appeal.
